  1. Introduction

(a) Website Owner. Gahvejian Enterprises, Inc. d/b/a Mid Valley Packaging & Supply Co. (“MVP”) is the owner of this website ( the “Site”). MVP can be contacted by mail at P.O. Box 96, Fowler, CA 93625, by phone at (559) 834-5956, or by e-mail at info@mvpsupply.com. This online privacy notice discloses MVP’s information practices for the Site, including what type of personally identifiable information is collected, how the information is used, and with whom the information is shared.

(b) Website Visits. In general, you can visit/use the Site without disclosing or revealing any personally identifiable information. Anyone who visits/uses the Site is referred to throughout this policy as:  “user” or “you.”  The Site provides an option for users to input certain specified personally identifiable information for the purpose of requesting information from MVP or communicating with MVP.  In this way, a user will generally be aware of, and be able to actively cause or refrain from causing, the provision of personally identifiable information on the Site.

  1. Personal Information That May Be Collected

(a) Identifying Information. In order to request certain information (such as a quote or product samples) or to use the Site to send an electronic communication to MVP (each of which is referred to as a “Site Contact”), the Site will request a user to provide certain personally identifiable information, which may include: name, company name, e-mail address, and telephone number. MVP may request additional information necessary to fulfill the user’s purpose in making the Site Contact.

(b) Follow Up Contact. A Site Contact by a user might require MVP to contact the user relative to the Site Contact.  By submitting a Site Contact, you are consenting to MVP contacting you during normal business hours relative to your Site Contact.

(c) Information from Children. MVP does not collect or maintain information from users actually known to be under the age of 18, and no part of the Site is structured to attract anyone under the age of 18.

(d) Links to Other Websites. The Site may contain links to other websites. MVP is not responsible for the privacy practices or the content of those other websites.

  1. Uses Made of the Information

(a) Limited Uses Identified.  MVP uses the personally identifiable information of a user: to respond to and otherwise address the user’s Site Contact; and for other limited purposes set forth in this policy.

(b) Marketing Uses. Unless a user marks an “x” on the opt-out option box provided in connection with submitting the user’s personally identifiable information to MVP through the Site Contact, MVP reserves the right to use such personally identifiable information to provide a user with future information (beyond that which directly responds to a Site Contact) about the Site, MVP’s products and services, and related information in which user’s Site Contact suggests to MVP that user has an interest.

(c) Stored Information Uses. MVP stores and retains the information provided by a user through the Site. This information is used by MVP and/or MVP’s agents for the purposes indicated in this policy.

(d) Online Advertising. Some companies that may help MVP deliver interactive on-line advertising, such as banner ads, may collect and use information that has been collected through the Site to help MVP better understand the types of advertising or promotions that are most appealing to MVP’s customers. Prior to that collection and use by outside companies that are helping MVP in that regard, the information would be aggregated so that it is not identifiable to a specific individual.

  1. Disclosure of the Information

(a) Within Corporate Organization. MVP may share your personally identifiable information within the MVP corporate organization for its business purposes.

(b) Business/Asset Sales or Purchases.  Circumstances may arise where for its business reasons, MVP decides to sell, purchase, share, or rent business assets, either as part of a business sale or sale of business assets. In such a transaction, customer and lead information is generally one of the transferred business assets. This may include your personally identified information collected through the Site.

(c) Agents. MVP may employ or engage other companies and individuals to perform business functions on behalf of MVP. These persons may be provided with personally identifiable information required to perform their functions, but would be prohibited by contract from using the information for other purposes. These persons may engage in a variety of functions which may include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, and providing customer services.

(d) Marketing Analysis by Third Parties. MVP reserves the right to disclose to third parties personally identifiable information about users of the Site for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual user.

(e) Disclosure to Governmental Authorities. MVP may release personally identifiable information when MVP reasonably believes such release is appropriate to: comply with law; enforce agreements; or comply with a request of a government agency conducting an investigation or proceeding.

  1. Use of Computer Tracking Technologies

(a) No Tracking of Personal Information Not Entered. The Site is not set up to track, collect or distribute personal information not entered by users.

(b) Collection of Non-Identifiable Information. Through website access logs, MVP may collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.

(c) Collection of Personal Information. As previously set forth above in section 2(a), MVP may collect certain personally identifiable information from users during their visits. MVP may extract some personally identifiable information about that visit in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help MVP understand trends and patterns. This information is not reviewed at an individual level.

  1. Information Security

(a) Commitment to Online Security. MVP intends to protect user personal information. To achieve information security and quality, MVP implements appropriate measures and processes, such as using encryption when transmitting certain sensitive information.

(b) No Liability for Acts of Third Parties. MVP will exercise all reasonable efforts to safeguard the confidentiality of user personal information. However, MVP shall not be liable for unauthorized disclosure of personal information due to no fault of MVP including, but not limited to, errors in transmission and unauthorized acts of  MVP staff and/or third parties.

  1. Privacy Policy Changes and Opt-Out Rights

(a) Changes to Privacy Policy. This privacy notice was last updated on November 10, 2014. MVP reserves the right to change its privacy policy statement at any time. A notice of any material change will be posted on the Site home page for fifteen (15) days prior to the implementation of such change.  By using the Site after the implementation of such change, the user will be deemed to have accepted MVP’s privacy policy updates.

(b) Opt-Out Right. A user has the right at any time to cease permitting personal information to be collected, used or disclosed by MVP and/or by any third parties with whom MVP has shared and/or transferred such personal information. This right of cancellation may be exercised by contacting MVP via certified postal mail sent to the address for MVP set forth above in section 1(a). After processing the cancellation, MVP will delete user’s personal information from its data base.

  1. Access Rights to Data

(a) Information Maintained by MVP. Upon a user’s request, MVP will provide a reasonable description of user’s personally identifiable information concerning such user that has been collected from the Site and that MVP maintains in its database. In this regard, MVP can be contacted by certified postal mail sent to the address for MVP set forth above in section 1(a).

(b) Corrections and Changes to Personal Information. Help MVP to keep user personal information accurate. If your personal information changes, or if you note an error upon review of your information that MVP has on file, please promptly e-mail MVP at info@mvpsupply.com and provide the new or correct information.

  1. Accountability

(a) Questions, Problems and Complaints. If you have a question about this policy statement, or a complaint about MVP’s compliance with this privacy policy, you may contact MVP by e-mail at info@mvpsupply.com.

(b) Terms of Use. If you choose to use the Site, your action is hereby deemed acceptance of MVP practices described in this policy statement. Any dispute over privacy between a user and MVP is subject to the provisions of this notice and to MVP’s Terms of Use Agreement which is hereby incorporated herein and which can be read at www.mvpsupply.com/index.php/legal/terms.
